1. Introduction
Welcome to East-West Tech Talent (“EWTechTalent”). These Terms and Conditions (“Terms”) govern your use of our website and services. By accessing our website or engaging our services, you agree to comply with and be bound by these Terms. If you do not agree, please refrain from using our website and services.
2. Services Provided
EWTechTalent specializes in connecting businesses with skilled remote professionals, primarily from the Philippines, with plans to expand to other regions in the future. While our focus is on tech-related roles, we offer recruitment services for a variety of positions. Our services include sourcing, vetting, and facilitating the hiring of candidates based on client requirements.
3. User Responsibilities
Clients are responsible for providing accurate and comprehensive job descriptions and requirements. They must also conduct their own due diligence during the interview and selection process. Clients agree to use the information provided by EWTechTalent solely for recruitment purposes and not to disclose candidate information to unauthorized parties.
4. Client and Contractor Relationship Disclaimer
EWTechTalent acts as an intermediary in the recruitment process. All candidates introduced by EWTechTalent are independent contractors and not employees of EWTechTalent. Clients acknowledge that EWTechTalent does not manage the onboarding, performance, or ongoing relationship between the client and the contractor. Clients are responsible for establishing contractual agreements directly with the contractors, including terms of engagement, compensation, and compliance with applicable labor laws.
5. Fees and Payment Terms
Clients agree to a minimum commitment of three (3) months upon successfully hiring a candidate through EWTechTalent. Fees are structured on a cost-plus model, comprising the contractor’s salary and a service fee charged by EWTechTalent. Detailed payment terms, including invoicing schedules and payment methods, will be outlined in a separate agreement between the client and EWTechTalent.
6. Non-Circumvention
Clients agree not to engage or hire any candidates introduced by EWTechTalent independently, without involving EWTechTalent, for a period of sixty (60) months from the date of introduction. Any breach of this clause will result in legal action to recover damages and lost revenue.
7. Intellectual Property
All content on the EWTechTalent website, including text, graphics, logos, and software, is the property of EWTechTalent or its content suppliers and is protected by intellectual property laws. Unauthorized use of any content is prohibited.
8. Limitation of Liability
EWTechTalent is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our services or website. This includes, but is not limited to, issues related to the hiring process, contractor performance, or any disputes between clients and contractors.
9. Privacy and Data Use
We are committed to protecting your privacy. Our Privacy Policy outlines how we collect, use, and safeguard your information. By using our services, you consent to the data practices described therein.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Israel. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Tel Aviv, Israel.
11. Modifications
EWTechTalent reserves the right to modify these Terms at any time. Any changes will be posted on our website with an updated effective date. Your continued use of our services after such modifications constitutes your acceptance of the revised Terms.
